各省(sheng)、自治區(qu)、直轄(xia)市(shi)人民政(zheng)府,國(guo)務院各部委、各直屬機構(gou):
工(gong)程建設(she)項(xiang)目(mu)審(shen)(shen)批(pi)制度(du)(du)改(gai)(gai)革(ge)是黨中央(yang)、國務院(yuan)在新形勢下作(zuo)出的(de)(de)(de)重(zhong)大決策,是推進政府職能轉(zhuan)變和深(shen)化“放管服”改(gai)(gai)革(ge)、優化營商環境的(de)(de)(de)重(zhong)要內容。2018年5月工(gong)程建設(she)項(xiang)目(mu)審(shen)(shen)批(pi)制度(du)(du)改(gai)(gai)革(ge)試點(dian)開展以來,試點(dian)地(di)區按照國務院(yuan)部署,對工(gong)程建設(she)項(xiang)目(mu)審(shen)(shen)批(pi)制度(du)(du)實施了全(quan)流程、全(quan)覆蓋改(gai)(gai)革(ge),基本形成(cheng)統(tong)(tong)一的(de)(de)(de)審(shen)(shen)批(pi)流程、統(tong)(tong)一的(de)(de)(de)信息數據平臺、統(tong)(tong)一的(de)(de)(de)審(shen)(shen)批(pi)管理(li)體(ti)系(xi)和統(tong)(tong)一的(de)(de)(de)監(jian)管方式。經國務院(yuan)同意,現就(jiu)全(quan)面(mian)開展工(gong)程建設(she)項(xiang)目(mu)審(shen)(shen)批(pi)制度(du)(du)改(gai)(gai)革(ge)提出以下意見(jian)。
一、總體要(yao)求
(一)指導(dao)思想。以(yi)習近(jin)平新時代中(zhong)(zhong)(zhong)國特色(se)社會主義思想為(wei)(wei)指導(dao),深入(ru)貫徹黨的十九(jiu)(jiu)大(da)和(he)十九(jiu)(jiu)屆二中(zhong)(zhong)(zhong)、三中(zhong)(zhong)(zhong)全會精神,堅持以(yi)人民為(wei)(wei)中(zhong)(zhong)(zhong)心,牢固(gu)樹立新發展(zhan)(zhan)理(li)(li)念,以(yi)推進(jin)政(zheng)府治理(li)(li)體系和(he)治理(li)(li)能力現(xian)代化為(wei)(wei)目標,以(yi)更好更快方(fang)便(bian)企業(ye)和(he)群(qun)眾辦(ban)事為(wei)(wei)導(dao)向,加(jia)大(da)轉變政(zheng)府職能和(he)簡政(zheng)放權(quan)力度(du),全面開展(zhan)(zhan)工程建設項目審批制度(du)改革,統(tong)(tong)(tong)一審批流程,統(tong)(tong)(tong)一信息數據平臺(tai),統(tong)(tong)(tong)一審批管(guan)(guan)理(li)(li)體系,統(tong)(tong)(tong)一監管(guan)(guan)方(fang)式,實現(xian)工程建設項目審批“四(si)統(tong)(tong)(tong)一”。
(二)改革內容。對工(gong)程建設(she)(she)項(xiang)(xiang)目審(shen)(shen)批制度實施全流程、全覆蓋改革。改革覆蓋工(gong)程建設(she)(she)項(xiang)(xiang)目審(shen)(shen)批全過程(包括從立項(xiang)(xiang)到竣工(gong)驗收和(he)公(gong)共設(she)(she)施接入服務);主要是房屋建筑和(he)城(cheng)市基礎(chu)設(she)(she)施等(deng)工(gong)程,不包括特殊(shu)工(gong)程和(he)交(jiao)通、水利、能源(yuan)等(deng)領(ling)域的(de)重大工(gong)程;覆蓋行政許可(ke)等(deng)審(shen)(shen)批事項(xiang)(xiang)和(he)技術審(shen)(shen)查、中介服務、市政公(gong)用(yong)服務以及備(bei)案等(deng)其他類型事項(xiang)(xiang),推動流程優(you)化和(he)標準化。
(三(san))主要目(mu)標(biao)。2019年(nian)上(shang)半年(nian),全國工(gong)程(cheng)(cheng)建(jian)設項(xiang)目(mu)審(shen)(shen)批時間壓縮至120個工(gong)作日(ri)以內,省(自治區)和地(di)級(ji)及以上(shang)城市初步建(jian)成工(gong)程(cheng)(cheng)建(jian)設項(xiang)目(mu)審(shen)(shen)批制度(du)(du)框(kuang)架和信息數(shu)據平(ping)臺;到2019年(nian)底(di),工(gong)程(cheng)(cheng)建(jian)設項(xiang)目(mu)審(shen)(shen)批管理(li)系(xi)統(tong)與相關系(xi)統(tong)平(ping)臺互聯互通;試點(dian)地(di)區繼(ji)續深化(hua)改(gai)革,加大改(gai)革創(chuang)新力度(du)(du),進一步精簡審(shen)(shen)批環節和事項(xiang),減(jian)少(shao)審(shen)(shen)批階段,壓減(jian)審(shen)(shen)批時間,加強輔(fu)導服務,提高審(shen)(shen)批效能。到2020年(nian)底(di),基本建(jian)成全國統(tong)一的工(gong)程(cheng)(cheng)建(jian)設項(xiang)目(mu)審(shen)(shen)批和管理(li)體系(xi)。
二(er)、統一審批流程
(四)精(jing)簡審(shen)(shen)(shen)批(pi)(pi)(pi)環(huan)節。精(jing)減(jian)(jian)審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項和條件,取消不合法、不合理(li)、不必(bi)要的(de)審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項,減(jian)(jian)少保留事(shi)(shi)(shi)項的(de)前置條件。下(xia)(xia)放(fang)審(shen)(shen)(shen)批(pi)(pi)(pi)權限,按照方便企業和群眾辦事(shi)(shi)(shi)的(de)原則,對(dui)下(xia)(xia)級機關(guan)(guan)(guan)有(you)能(neng)(neng)力(li)承接(jie)的(de)審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項,下(xia)(xia)放(fang)或委托(tuo)下(xia)(xia)級機關(guan)(guan)(guan)審(shen)(shen)(shen)批(pi)(pi)(pi)。合并審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項,對(dui)由同(tong)一(yi)部門實施(shi)的(de)管理(li)內(nei)容相(xiang)(xiang)近或者屬于同(tong)一(yi)辦理(li)階段的(de)多個(ge)審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項,整合為(wei)(wei)一(yi)個(ge)審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項。轉(zhuan)變管理(li)方式,對(dui)能(neng)(neng)夠用征求相(xiang)(xiang)關(guan)(guan)(guan)部門意見方式替代的(de)審(shen)(shen)(shen)批(pi)(pi)(pi)事(shi)(shi)(shi)項,調整為(wei)(wei)政(zheng)(zheng)府(fu)內(nei)部協(xie)作事(shi)(shi)(shi)項。調整審(shen)(shen)(shen)批(pi)(pi)(pi)時序(xu),地震安全性評價(jia)在(zai)工程設(she)(she)計(ji)前完(wan)成(cheng)(cheng)即(ji)可(ke)(ke)(ke),環(huan)境影(ying)響評價(jia)、節能(neng)(neng)評價(jia)等(deng)評估評價(jia)和取水許可(ke)(ke)(ke)等(deng)事(shi)(shi)(shi)項在(zai)開(kai)(kai)工前完(wan)成(cheng)(cheng)即(ji)可(ke)(ke)(ke);可(ke)(ke)(ke)以將(jiang)用地預審(shen)(shen)(shen)意見作為(wei)(wei)使用土地證明(ming)文件申請(qing)辦理(li)建設(she)(she)工程規(gui)劃許可(ke)(ke)(ke)證;將(jiang)供(gong)水、供(gong)電(dian)、燃氣、熱力(li)、排水、通信(xin)等(deng)市政(zheng)(zheng)公用基礎設(she)(she)施(shi)報裝提前到開(kai)(kai)工前辦理(li),在(zai)工程施(shi)工階段完(wan)成(cheng)(cheng)相(xiang)(xiang)關(guan)(guan)(guan)設(she)(she)施(shi)建設(she)(she),竣工驗收后直接(jie)辦理(li)接(jie)入事(shi)(shi)(shi)宜。試點地區要進一(yi)步精(jing)簡審(shen)(shen)(shen)批(pi)(pi)(pi)環(huan)節,在(zai)加(jia)快探(tan)索取消施(shi)工圖審(shen)(shen)(shen)查(cha)(或縮小審(shen)(shen)(shen)查(cha)范圍)、實行告知承諾制(zhi)和設(she)(she)計(ji)人員終身負責制(zhi)等(deng)方面,盡(jin)快形成(cheng)(cheng)可(ke)(ke)(ke)復制(zhi)可(ke)(ke)(ke)推(tui)廣(guang)的(de)經驗。
(五(wu))規(gui)范審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)。各地要(yao)(yao)按(an)照國(guo)務院統(tong)一(yi)要(yao)(yao)求,對本地區工程(cheng)建設項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)目(mu)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)進行(xing)全(quan)面(mian)清(qing)(qing)理(li),統(tong)一(yi)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)和(he)法律依據,逐(zhu)步形成(cheng)全(quan)國(guo)統(tong)一(yi)的(de)(de)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)名稱、申請材料和(he)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)時限。要(yao)(yao)本著合法、精簡、效(xiao)能(neng)的(de)(de)原則(ze)(ze),制定國(guo)家、省(自治區)和(he)地級(ji)(ji)及以上城市工程(cheng)建設項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)目(mu)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)清(qing)(qing)單(dan),明確(que)各項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)的(de)(de)適用范圍和(he)前置條件,并實行(xing)動態管理(li)。下級(ji)(ji)政府(fu)制定的(de)(de)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)清(qing)(qing)單(dan)原則(ze)(ze)上要(yao)(yao)與上級(ji)(ji)政府(fu)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)清(qing)(qing)單(dan)一(yi)致,超出上級(ji)(ji)政府(fu)審(shen)(shen)(shen)批(pi)(pi)(pi)(pi)事(shi)項(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)(xiang)清(qing)(qing)單(dan)范圍的(de)(de),要(yao)(yao)報(bao)上級(ji)(ji)機關備案,并說明理(li)由。
(六(liu))合理劃分審(shen)批階段。將工(gong)(gong)(gong)(gong)(gong)程建(jian)設(she)(she)項(xiang)目審(shen)批流程主(zhu)要(yao)(yao)劃分為立項(xiang)用(yong)地(di)(di)規(gui)(gui)劃許(xu)可(ke)、工(gong)(gong)(gong)(gong)(gong)程建(jian)設(she)(she)許(xu)可(ke)、施工(gong)(gong)(gong)(gong)(gong)許(xu)可(ke)、竣工(gong)(gong)(gong)(gong)(gong)驗收(shou)(shou)四個(ge)階段。其中(zhong),立項(xiang)用(yong)地(di)(di)規(gui)(gui)劃許(xu)可(ke)階段主(zhu)要(yao)(yao)包括(kuo)項(xiang)目審(shen)批核(he)(he)(he)準、選址意見(jian)書核(he)(he)(he)發(fa)、用(yong)地(di)(di)預(yu)審(shen)、用(yong)地(di)(di)規(gui)(gui)劃許(xu)可(ke)證核(he)(he)(he)發(fa)等(deng)。工(gong)(gong)(gong)(gong)(gong)程建(jian)設(she)(she)許(xu)可(ke)階段主(zhu)要(yao)(yao)包括(kuo)設(she)(she)計(ji)方案審(shen)查(cha)、建(jian)設(she)(she)工(gong)(gong)(gong)(gong)(gong)程規(gui)(gui)劃許(xu)可(ke)證核(he)(he)(he)發(fa)等(deng)。施工(gong)(gong)(gong)(gong)(gong)許(xu)可(ke)階段主(zhu)要(yao)(yao)包括(kuo)設(she)(she)計(ji)審(shen)核(he)(he)(he)確認、施工(gong)(gong)(gong)(gong)(gong)許(xu)可(ke)證核(he)(he)(he)發(fa)等(deng)。竣工(gong)(gong)(gong)(gong)(gong)驗收(shou)(shou)階段主(zhu)要(yao)(yao)包括(kuo)規(gui)(gui)劃、土地(di)(di)、消防、人(ren)防、檔案等(deng)驗收(shou)(shou)及(ji)竣工(gong)(gong)(gong)(gong)(gong)驗收(shou)(shou)備案等(deng)。其他(ta)行(xing)(xing)政許(xu)可(ke)、強(qiang)制性評(ping)估、中(zhong)介服務(wu)(wu)、市政公用(yong)服務(wu)(wu)以及(ji)備案等(deng)事(shi)項(xiang)納(na)入相(xiang)(xiang)關(guan)階段辦理或(huo)與相(xiang)(xiang)關(guan)階段并行(xing)(xing)推(tui)進。每個(ge)審(shen)批階段確定(ding)一(yi)家牽頭部門(men)(men),實(shi)行(xing)(xing)“一(yi)家牽頭、并聯審(shen)批、限(xian)時辦結”,由牽頭部門(men)(men)組織協調相(xiang)(xiang)關(guan)部門(men)(men)嚴格按照限(xian)定(ding)時間完成審(shen)批。
(七(qi))分(fen)(fen)類(lei)制定(ding)審(shen)批(pi)(pi)流(liu)程(cheng)(cheng)(cheng)。制定(ding)全(quan)國統(tong)一(yi)(yi)的(de)(de)工(gong)程(cheng)(cheng)(cheng)建(jian)設(she)項目審(shen)批(pi)(pi)流(liu)程(cheng)(cheng)(cheng)圖(tu)示范(fan)文本(ben)。地(di)級(ji)及以(yi)上地(di)方(fang)人民(min)政府要(yao)根據(ju)示范(fan)文本(ben),分(fen)(fen)別(bie)(bie)制定(ding)政府投(tou)資、社會(hui)投(tou)資等(deng)不(bu)同類(lei)型(xing)工(gong)程(cheng)(cheng)(cheng)的(de)(de)審(shen)批(pi)(pi)流(liu)程(cheng)(cheng)(cheng)圖(tu);同時可結合(he)實際,根據(ju)工(gong)程(cheng)(cheng)(cheng)建(jian)設(she)項目類(lei)型(xing)、投(tou)資類(lei)別(bie)(bie)、規模(mo)大(da)小等(deng),進一(yi)(yi)步梳理合(he)并審(shen)批(pi)(pi)流(liu)程(cheng)(cheng)(cheng)。簡(jian)化(hua)社會(hui)投(tou)資的(de)(de)中(zhong)小型(xing)工(gong)程(cheng)(cheng)(cheng)建(jian)設(she)項目審(shen)批(pi)(pi),對(dui)于帶方(fang)案出(chu)讓(rang)土(tu)地(di)的(de)(de)項目,不(bu)再對(dui)設(she)計方(fang)案進行審(shen)核(he),將工(gong)程(cheng)(cheng)(cheng)建(jian)設(she)許可和施工(gong)許可合(he)并為(wei)一(yi)(yi)個(ge)階段。試點地(di)區要(yao)進一(yi)(yi)步加大(da)改革力(li)度(du),也(ye)可以(yi)在其他工(gong)程(cheng)(cheng)(cheng)建(jian)設(she)項目中(zhong)探索將工(gong)程(cheng)(cheng)(cheng)建(jian)設(she)許可和施工(gong)許可合(he)并為(wei)一(yi)(yi)個(ge)階段。
(八)實行(xing)聯(lian)合(he)審(shen)(shen)圖和聯(lian)合(he)驗(yan)收(shou)(shou)。制定施工圖設(she)計文件(jian)聯(lian)合(he)審(shen)(shen)查(cha)和聯(lian)合(he)竣(jun)(jun)工驗(yan)收(shou)(shou)管理辦法。將消(xiao)防(fang)、人(ren)防(fang)、技(ji)防(fang)等技(ji)術審(shen)(shen)查(cha)并入(ru)施工圖設(she)計文件(jian)審(shen)(shen)查(cha),相關(guan)部門不再進(jin)行(xing)技(ji)術審(shen)(shen)查(cha)。實行(xing)規劃(hua)、土地、消(xiao)防(fang)、人(ren)防(fang)、檔案等事項(xiang)限時聯(lian)合(he)驗(yan)收(shou)(shou),統一(yi)竣(jun)(jun)工驗(yan)收(shou)(shou)圖紙和驗(yan)收(shou)(shou)標準,統一(yi)出具驗(yan)收(shou)(shou)意(yi)見。對于驗(yan)收(shou)(shou)涉及的測繪工作,實行(xing)“一(yi)次委托、聯(lian)合(he)測繪、成果共享”。
(九)推行(xing)(xing)區(qu)域(yu)(yu)評估(gu)。在(zai)各類開(kai)發區(qu)、工業園區(qu)、新區(qu)和其他(ta)有(you)條件(jian)的區(qu)域(yu)(yu),推行(xing)(xing)由(you)政(zheng)府統一(yi)組(zu)織對(dui)壓覆(fu)重要礦(kuang)產(chan)資(zi)源(yuan)、環境影響評價、節能評價、地(di)質災(zai)害(hai)危險性評估(gu)、地(di)震(zhen)安(an)全性評價、水資(zi)源(yuan)論證等(deng)評估(gu)評價事項實行(xing)(xing)區(qu)域(yu)(yu)評估(gu)。實行(xing)(xing)區(qu)域(yu)(yu)評估(gu)的,政(zheng)府相關部門應(ying)在(zai)土地(di)出讓或(huo)劃撥前,告知建設單位相關建設要求。
(十)推行(xing)告(gao)知(zhi)承(cheng)諾(nuo)制。對(dui)通(tong)過(guo)事中事后(hou)監管能夠糾正不符合審(shen)批(pi)條件的(de)(de)(de)行(xing)為且不會產生嚴重后(hou)果的(de)(de)(de)審(shen)批(pi)事項(xiang)(xiang),實(shi)行(xing)告(gao)知(zhi)承(cheng)諾(nuo)制。公布實(shi)行(xing)告(gao)知(zhi)承(cheng)諾(nuo)制的(de)(de)(de)工(gong)程(cheng)(cheng)建設項(xiang)(xiang)目(mu)審(shen)批(pi)事項(xiang)(xiang)清單及具體要(yao)求(qiu)(qiu),申(shen)請(qing)人按照(zhao)要(yao)求(qiu)(qiu)作(zuo)出(chu)書面承(cheng)諾(nuo)的(de)(de)(de),審(shen)批(pi)部門可以根據(ju)申(shen)請(qing)人信(xin)用等情況直接作(zuo)出(chu)審(shen)批(pi)決定。對(dui)已經實(shi)施(shi)區域評(ping)估范圍內的(de)(de)(de)工(gong)程(cheng)(cheng)建設項(xiang)(xiang)目(mu),相應(ying)的(de)(de)(de)審(shen)批(pi)事項(xiang)(xiang)實(shi)行(xing)告(gao)知(zhi)承(cheng)諾(nuo)制。
三、統一信息數據(ju)平臺(tai)

四(si)、統一審批管(guan)理體(ti)系
(十(shi)二)“一(yi)張藍圖”統籌(chou)項(xiang)(xiang)目(mu)實施。統籌(chou)整合(he)(he)各(ge)類(lei)規劃(hua),劃(hua)定各(ge)類(lei)控制(zhi)線,構建(jian)“多(duo)規合(he)(he)一(yi)”的“一(yi)張藍圖”。依托工程建(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)審批(pi)管理系統,加(jia)強“多(duo)規合(he)(he)一(yi)”業(ye)務協同,統籌(chou)協調各(ge)部(bu)門(men)(men)對工程建(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)提出建(jian)設(she)(she)(she)條(tiao)件(jian)以(yi)及需要開展的評(ping)估評(ping)價事(shi)項(xiang)(xiang)等要求,為項(xiang)(xiang)目(mu)建(jian)設(she)(she)(she)單位落實建(jian)設(she)(she)(she)條(tiao)件(jian)、相關部(bu)門(men)(men)加(jia)強監督管理提供(gong)依據,加(jia)速項(xiang)(xiang)目(mu)前期策劃(hua)生成,簡化(hua)項(xiang)(xiang)目(mu)審批(pi)或核準手(shou)續。
(十三)“一(yi)個(ge)窗(chuang)(chuang)口”提供綜(zong)合(he)服務(wu)(wu)。縣級及以上城市人民政府要(yao)(yao)加強政務(wu)(wu)大廳(ting)建(jian)設,發揮服務(wu)(wu)企業(ye)群眾、監督(du)協調審(shen)(shen)(shen)批(pi)的作(zuo)用(yong)。整合(he)各(ge)(ge)部門和(he)各(ge)(ge)市政公用(yong)單位分散設立(li)(li)的服務(wu)(wu)窗(chuang)(chuang)口,設立(li)(li)工程(cheng)建(jian)設項(xiang)目審(shen)(shen)(shen)批(pi)綜(zong)合(he)服務(wu)(wu)窗(chuang)(chuang)口。建(jian)立(li)(li)完善(shan)“前臺受理(li)、后臺審(shen)(shen)(shen)核(he)”機制(zhi),綜(zong)合(he)服務(wu)(wu)窗(chuang)(chuang)口統(tong)一(yi)收件、出件,實(shi)現“一(yi)個(ge)窗(chuang)(chuang)口”服務(wu)(wu)和(he)管理(li)。省級人民政府要(yao)(yao)統(tong)一(yi)制(zhi)定(ding)本地區“一(yi)窗(chuang)(chuang)受理(li)”的工作(zuo)規程(cheng)。鼓勵為申請人提供工程(cheng)建(jian)設項(xiang)目審(shen)(shen)(shen)批(pi)咨詢、指導(dao)、協調和(he)代(dai)辦等服務(wu)(wu),幫助企業(ye)了解(jie)審(shen)(shen)(shen)批(pi)要(yao)(yao)求(qiu),提供相關工程(cheng)建(jian)設項(xiang)目的申請材(cai)料清單,提高(gao)申報通過率。
(十四)“一(yi)張表單”整合申(shen)(shen)(shen)(shen)報(bao)(bao)材料(liao)。各審批階段均實行“一(yi)份辦(ban)(ban)事(shi)指南(nan),一(yi)張申(shen)(shen)(shen)(shen)請(qing)表單,一(yi)套申(shen)(shen)(shen)(shen)報(bao)(bao)材料(liao),完成多項(xiang)審批”的(de)運作模式,牽頭部門制(zhi)定(ding)統(tong)一(yi)的(de)辦(ban)(ban)事(shi)指南(nan)和(he)申(shen)(shen)(shen)(shen)報(bao)(bao)表格,每個審批階段申(shen)(shen)(shen)(shen)請(qing)人只需(xu)(xu)提(ti)交一(yi)套申(shen)(shen)(shen)(shen)報(bao)(bao)材料(liao)。建立完善審批清單服務機(ji)制(zhi),主動為申(shen)(shen)(shen)(shen)請(qing)人提(ti)供(gong)項(xiang)目(mu)需(xu)(xu)要審批的(de)事(shi)項(xiang)清單。不(bu)同審批階段的(de)審批部門應當共享(xiang)申(shen)(shen)(shen)(shen)報(bao)(bao)材料(liao),不(bu)得要求申(shen)(shen)(shen)(shen)請(qing)人重(zhong)復提(ti)交。
(十(shi)五)“一套機(ji)制(zhi)(zhi)”規范審批(pi)運行。建(jian)立(li)健全工程建(jian)設項目審批(pi)配(pei)套制(zhi)(zhi)度(du)(du),明確(que)部(bu)門職(zhi)責(ze),明晰工作規程,規范審批(pi)行為,確(que)保(bao)審批(pi)各階段、各環節無縫銜接。建(jian)立(li)審批(pi)協調(diao)機(ji)制(zhi)(zhi),協調(diao)解決部(bu)門意見分歧。建(jian)立(li)跟蹤督辦(ban)制(zhi)(zhi)度(du)(du),實(shi)時跟蹤審批(pi)辦(ban)理(li)情(qing)況,對全過程實(shi)施督辦(ban)。各級政府部(bu)門要主(zhu)動加強與(yu)人(ren)大及司法機(ji)構的溝通協調(diao)配(pei)合,加快法律法規、規范性文件和標(biao)準規范的立(li)改(gai)(gai)廢釋工作,修改(gai)(gai)或廢止與(yu)工程建(jian)設項目審批(pi)制(zhi)(zhi)度(du)(du)改(gai)(gai)革(ge)要求不相(xiang)符的相(xiang)關制(zhi)(zhi)度(du)(du),建(jian)立(li)依法推(tui)進改(gai)(gai)革(ge)的長效機(ji)制(zhi)(zhi)。
五、統一監管(guan)方式
(十六)加強(qiang)事(shi)(shi)(shi)中(zhong)事(shi)(shi)(shi)后監(jian)(jian)(jian)管(guan)。進一(yi)步轉變監(jian)(jian)(jian)管(guan)理(li)念,完(wan)善(shan)事(shi)(shi)(shi)中(zhong)事(shi)(shi)(shi)后監(jian)(jian)(jian)管(guan)體(ti)系,統一(yi)規(gui)范事(shi)(shi)(shi)中(zhong)事(shi)(shi)(shi)后監(jian)(jian)(jian)管(guan)模(mo)式,建立以(yi)“雙(shuang)隨機(ji)、一(yi)公開(kai)”監(jian)(jian)(jian)管(guan)為基本手段,以(yi)重點監(jian)(jian)(jian)管(guan)為補充,以(yi)信用監(jian)(jian)(jian)管(guan)為基礎的(de)新(xin)型(xing)監(jian)(jian)(jian)管(guan)機(ji)制,嚴肅查處違法違規(gui)行(xing)(xing)為。對(dui)于(yu)實行(xing)(xing)告知承(cheng)(cheng)諾(nuo)制的(de)審(shen)(shen)批事(shi)(shi)(shi)項,審(shen)(shen)批部門應當在規(gui)定時間內對(dui)承(cheng)(cheng)諾(nuo)人履行(xing)(xing)承(cheng)(cheng)諾(nuo)的(de)情況進行(xing)(xing)檢查,承(cheng)(cheng)諾(nuo)人未履行(xing)(xing)承(cheng)(cheng)諾(nuo)的(de),審(shen)(shen)批部門要依(yi)法撤銷行(xing)(xing)政審(shen)(shen)批決定并追究承(cheng)(cheng)諾(nuo)人的(de)相應責(ze)任。
(十七)加(jia)強(qiang)信(xin)(xin)(xin)(xin)用(yong)(yong)體(ti)系建(jian)(jian)設(she)。建(jian)(jian)立工(gong)程建(jian)(jian)設(she)項(xiang)(xiang)目審批信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)平臺(tai),完善申請(qing)人(ren)信(xin)(xin)(xin)(xin)用(yong)(yong)記錄,建(jian)(jian)立紅黑名單制度,實行信(xin)(xin)(xin)(xin)用(yong)(yong)分級(ji)分類管(guan)理,出臺(tai)工(gong)程建(jian)(jian)設(she)項(xiang)(xiang)目審批守(shou)信(xin)(xin)(xin)(xin)聯(lian)合(he)激勵和(he)失(shi)信(xin)(xin)(xin)(xin)聯(lian)合(he)懲(cheng)戒合(he)作備(bei)忘錄,對失(shi)信(xin)(xin)(xin)(xin)企業和(he)從業人(ren)員進(jin)行嚴格監管(guan)。將企業和(he)從業人(ren)員違(wei)法違(wei)規、不(bu)履行承諾的(de)失(shi)信(xin)(xin)(xin)(xin)行為(wei)納入(ru)工(gong)程建(jian)(jian)設(she)項(xiang)(xiang)目審批管(guan)理系統,并(bing)與全國信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)共享平臺(tai)互(hu)聯(lian)互(hu)通,加(jia)強(qiang)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)共享,構建(jian)(jian)“一處(chu)失(shi)信(xin)(xin)(xin)(xin)、處(chu)處(chu)受限”的(de)聯(lian)合(he)懲(cheng)戒機制。
(十八)規范中(zhong)介(jie)和(he)市(shi)政(zheng)公(gong)(gong)用服(fu)(fu)務(wu)(wu)(wu)(wu)。建(jian)(jian)立健全中(zhong)介(jie)服(fu)(fu)務(wu)(wu)(wu)(wu)和(he)市(shi)政(zheng)公(gong)(gong)用服(fu)(fu)務(wu)(wu)(wu)(wu)管(guan)理制(zhi)(zhi)度,實(shi)(shi)行服(fu)(fu)務(wu)(wu)(wu)(wu)承(cheng)諾制(zhi)(zhi),明(ming)確服(fu)(fu)務(wu)(wu)(wu)(wu)標(biao)準和(he)辦事流程,規范服(fu)(fu)務(wu)(wu)(wu)(wu)收費(fei)。依(yi)托工程建(jian)(jian)設(she)(she)項目審(shen)批管(guan)理系(xi)統建(jian)(jian)立中(zhong)介(jie)服(fu)(fu)務(wu)(wu)(wu)(wu)網上交(jiao)易平(ping)臺,對中(zhong)介(jie)服(fu)(fu)務(wu)(wu)(wu)(wu)行為實(shi)(shi)施全過程監(jian)管(guan)。供(gong)水(shui)、供(gong)電(dian)、燃氣、熱力(li)、排水(shui)、通信等市(shi)政(zheng)公(gong)(gong)用服(fu)(fu)務(wu)(wu)(wu)(wu)要(yao)全部入駐政(zheng)務(wu)(wu)(wu)(wu)服(fu)(fu)務(wu)(wu)(wu)(wu)大廳(ting),實(shi)(shi)施統一(yi)規范管(guan)理,為建(jian)(jian)設(she)(she)單位提供(gong)“一(yi)站式(shi)”服(fu)(fu)務(wu)(wu)(wu)(wu)。
六、加強組織實施
(十九)強化組織(zhi)(zhi)領導(dao)。住(zhu)房(fang)城鄉建(jian)(jian)設(she)部(bu)(bu)要(yao)(yao)切實(shi)(shi)擔負起工(gong)(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)項(xiang)目(mu)(mu)審批(pi)制(zhi)(zhi)度改(gai)革(ge)(ge)(ge)(ge)工(gong)(gong)(gong)(gong)作(zuo)的(de)組織(zhi)(zhi)協調(diao)和督促指(zhi)導(dao)責(ze)任(ren)(ren);各部(bu)(bu)門要(yao)(yao)密切協調(diao)配合(he),加(jia)(jia)強工(gong)(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)項(xiang)目(mu)(mu)審批(pi)制(zhi)(zhi)度改(gai)革(ge)(ge)(ge)(ge)、投(tou)資審批(pi)制(zhi)(zhi)度改(gai)革(ge)(ge)(ge)(ge)等“放管服”各項(xiang)改(gai)革(ge)(ge)(ge)(ge)任(ren)(ren)務的(de)協同聯動,形成(cheng)改(gai)革(ge)(ge)(ge)(ge)合(he)力。各省級(ji)人(ren)民政府要(yao)(yao)按(an)照本(ben)實(shi)(shi)施意(yi)見要(yao)(yao)求,全面領導(dao)本(ben)地區工(gong)(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)項(xiang)目(mu)(mu)審批(pi)制(zhi)(zhi)度改(gai)革(ge)(ge)(ge)(ge)工(gong)(gong)(gong)(gong)作(zuo),加(jia)(jia)強統籌協調(diao)、指(zhi)導(dao)和督促,為(wei)改(gai)革(ge)(ge)(ge)(ge)工(gong)(gong)(gong)(gong)作(zuo)提(ti)供組織(zhi)(zhi)和經費保(bao)障,積極(ji)推動各項(xiang)改(gai)革(ge)(ge)(ge)(ge)措施落地。各省級(ji)人(ren)民政府要(yao)(yao)在本(ben)實(shi)(shi)施意(yi)見印發(fa)后1個月內制(zhi)(zhi)定(ding)具體實(shi)(shi)施方案,并報住(zhu)房(fang)城鄉建(jian)(jian)設(she)部(bu)(bu)備案。各地方人(ren)民政府要(yao)(yao)高(gao)度重視工(gong)(gong)(gong)(gong)程(cheng)建(jian)(jian)設(she)項(xiang)目(mu)(mu)審批(pi)制(zhi)(zhi)度改(gai)革(ge)(ge)(ge)(ge)工(gong)(gong)(gong)(gong)作(zuo),承擔改(gai)革(ge)(ge)(ge)(ge)主體責(ze)任(ren)(ren),成(cheng)立(li)以主要(yao)(yao)負責(ze)同志為(wei)組長的(de)領導(dao)小組,明(ming)確責(ze)任(ren)(ren)部(bu)(bu)門,制(zhi)(zhi)定(ding)時間(jian)表、路線圖,確保(bao)按(an)時保(bao)質完成(cheng)任(ren)(ren)務。
(二十)加(jia)(jia)強溝(gou)通反(fan)饋(kui)和(he)(he)培訓。住(zhu)房城(cheng)鄉建(jian)設部要(yao)建(jian)立上下聯(lian)動的溝(gou)通反(fan)饋(kui)機制(zhi),及時了解(jie)地方(fang)工程(cheng)建(jian)設項目審(shen)批制(zhi)度(du)改革工作(zuo)情(qing)況(kuang),督促指導(dao)地方(fang)研究解(jie)決改革中遇到的問(wen)題(ti)。各地要(yao)針對(dui)(dui)重(zhong)點(dian)(dian)、難點(dian)(dian)問(wen)題(ti),采用集(ji)中培訓、網絡培訓和(he)(he)專題(ti)培訓等(deng)方(fang)式,加(jia)(jia)強對(dui)(dui)各級(ji)領(ling)導(dao)干(gan)部、工作(zuo)人(ren)員和(he)(he)申請(qing)人(ren)的業(ye)務(wu)培訓,對(dui)(dui)相關政策進行(xing)全面解(jie)讀(du)和(he)(he)輔(fu)導(dao),提高改革能力和(he)(he)業(ye)務(wu)水平(ping)。
(二十一(yi))嚴格(ge)督(du)促落實(shi)。住(zhu)房(fang)(fang)城(cheng)鄉建設(she)部要(yao)會同相關(guan)部門建立(li)工(gong)(gong)程建設(she)項(xiang)目審(shen)(shen)批制(zhi)度(du)改革(ge)評估評價機制(zhi),重點評估評價各地(di)全流(liu)程、全覆(fu)蓋改革(ge)和(he)統一(yi)審(shen)(shen)批流(liu)程、統一(yi)信息(xi)數據平(ping)臺(tai)、統一(yi)審(shen)(shen)批管理體(ti)系、統一(yi)監管方(fang)(fang)式等情況,并將(jiang)有關(guan)情況報國務院。地(di)方(fang)(fang)各級人民政府要(yao)加大對(dui)地(di)方(fang)(fang)有關(guan)部門工(gong)(gong)作的督(du)導力度(du),跟蹤改革(ge)任務落實(shi)情況。各省(sheng)級人民政府要(yao)定期向住(zhu)房(fang)(fang)城(cheng)鄉建設(she)部報送工(gong)(gong)作進展情況。對(dui)于工(gong)(gong)作推進不力、影響工(gong)(gong)程建設(she)項(xiang)目審(shen)(shen)批制(zhi)度(du)改革(ge)進程,特(te)別是未(wei)按時完成階段(duan)性工(gong)(gong)作目標的,要(yao)依法依規嚴肅問(wen)責(ze)。
(二(er)十二(er))做好宣(xuan)傳引(yin)導(dao)。各地要通過多種形式及時宣(xuan)傳報(bao)道相(xiang)關工作(zuo)措施和(he)取得的(de)成效,加強(qiang)輿論(lun)引(yin)導(dao),增進社會公眾(zhong)(zhong)對工程(cheng)建(jian)設(she)項目審批制(zhi)度改(gai)革(ge)工作(zuo)的(de)了解和(he)支持,及時回應群(qun)眾(zhong)(zhong)關切,為(wei)順利推進改(gai)革(ge)營(ying)造良好的(de)輿論(lun)環境。
